Arguments of the trends in support of the obligation of non-party states to bring the leaders of the Israeli occupation to criminal court

Abstract:
This study aimed to identify the arguments in favor of the commitment of non-party states to submit the leaders of the Israeli occupation to the International Criminal Court, especially after the request of the Prosecutor of the International Criminal Court on 5/20/2024 from the Pre-Trial Chamber of the International Criminal Court to issue an arrest warrant for the leaders of the Israeli occupation. The study concluded To a set of results, the most prominent of which is that there is a legal basis for this trend based on the purposes of the United Nations, which aim to maintain international peace and security. It is superior to any other obligation on member states of the United Nations, in addition to some other legal and objective arguments. The study recommended, That the Palestinian Ministry of Foreign Affairs move towards states that are not parties to the International Criminal Court to clarify these arguments and the importance of their cooperation in bringing the leaders of the Israeli occupation to the International Criminal Court.
